Welcome to CSS Web Design Co., Ltd. trading as Samui Media Group, Samui Web Design, Samui Graphic Design, Samui Marketing, and Samui Print (“we,” “us,” or “our”).

These Terms and Conditions govern all services provided by CSS Web Design Co., Ltd. to our clients (“you” or “Client”). By engaging our services, you agree to these terms.

1. Scope of Services

We provide web development, hosting, and email services as agreed upon in your proposal or contract. Any additional services requested outside the initial agreement may incur additional charges.

2. Payment Terms

– All invoices must be paid via bank transfer within 3 days of issuance unless otherwise stated.
– Late payments will incur a penalty of 1,000 THB per day after the due date. This penalty will be applied automatically without prior notice.

3. Non-Payment Consequences

In the event of non-payment:
– Hosting and email services will be suspended if invoices remain unpaid for more than 3 days from the due date.
– You will receive prior notification via email before any service discontinuation.
– A reactivation fee of 5,000 THB will be required to restore services.
– We bear no responsibility for data loss or interruptions caused by such suspensions.

4. Intellectual Property

– Ownership of website content, designs, and source code will transfer to you only upon full payment of all outstanding invoices.
– Until full payment on all outstanding invoices is received, all deliverables and content remain the property of CSS Web Design Co., Ltd.

5. Client Responsibilities

You agree to:
– Provide all necessary materials, content, and feedback required to complete the project promptly.
– Ensure content provided complies with applicable laws and does not infringe on third-party rights.

6. Service Delivery and Deadlines

We strive to meet agreed-upon deadlines. However, we are not responsible for delays caused by:
– Changes requested by you after project commencement.
– Delays in receiving required materials or approvals from you.

7. Hosting and Email Services

– Hosting and email services are offered through third-party providers.
– While providers perform regular backups, you are encouraged to maintain your own backups for critical data.
– We cannot guarantee 100% uptime but strive to ensure reliable service with minimal disruptions.

8. Liability

– Our liability is limited to the direct amount paid for the specific service in question.
– We are not liable for indirect or consequential damages, including but not limited to financial losses, data loss, or reputational harm.

9. Termination

– Either party may terminate the agreement with 15 days’ written notice.
– Upon termination, all outstanding invoices must be paid immediately.

10. Governing Law

This agreement is governed by the laws of Thailand.

11. Amendments

We reserve the right to amend these terms at any time. Clients will be notified of significant changes via email.
